Rapidshare loses in court, shut-down imminent? [news]

The German music rights holders asociation GEMA, which is something like the German ASCAP, scored another legal win against the one-click file hoster Rapidshare. GEMA announced in a press release that the Dusseldorf district court ruled this week that Rapidshare is going to have to block access to works from the GEMA repertoire.

Rapidshare has been using the defense that only its users can be held responsible for copyright violations. The Dusseldorf district court disagreed because it found that Rapidshare is mostly used for illegal activities and that the company generates substantial profits from these activities.

According to GEMA, the ruling includes a mandate to stop file transfers even if that means shutting the service down completely. GEMA's press release quotes the ruling with the following words:

"The ruling forces Rapidshare to 'take measures that might have the risk of making Rapidshare's service substantially less attractive or even close it down completely.'"

GEMA won two previous injunctions against Rapidshare, but this is the first time they won an actual court case. It's unclear yet how Rapidshare is going to respond to the ruling. The company running Rapidshare.com is based in Switzerland, but its original Rapidshare.de service was founded in Germany.

Although the music of Norah Jones continues to blend pop, soul, folk, and country with a seasoning of jazz, her third album for Blue Note is the first where she's written (or collaborated on) all the material. Beneath the smooth surface lie darker strains on the album-opening "Wish I Could" (about a boyfriend lost to war), intimations of mortality in "The Sun Doesn't Like You," and the post-election horrors of "My Dear Country." The last seems to channel the inspiration of Brecht/Weill, while the equally bleak "Sinkin' Soon" is set to a jaunty Dixieland rag. Throughout, Jones's vocal intimacy and melodic warmth remain as disarmingly understated as ever. The soulful "Thinking of You," the countryish "Wake Me Up," and the syncopated "Be My Somebody" reflect the captivating style of her previous work. Although too much in the same midtempo mode becomes a dreamy lull, cut by cut, Jones's voice is irresistible. --Don McLeese

Essential Bio:

Radiohead started as five blokes from Oxfordshire, England who played a few instruments. They ended up as one of the most important, praised and interesting modern rock acts. Whether pushing the boundaries of what is considered "marketable" rock music or reinventing their own sound, time and time again, Radiohead manage to embody the spirit of alternative rock while maintaining an international profile and a massive level of mainstream popularity.

The Early Years (1986-1993):

As schoolboys, Radiohead started a band entitled On A Friday. (Guess which day they rehearsed.) After most of them graduated, went off to university, then returned home, they started playing more high profile gigs -- to mixed success (i.e. the press hated them). Eventually, they were signed to EMI with a six-record deal. In 1992 they released their debut studio album Pablo Honey with single "Creep." It was blacklisted from UK radio (for being too mopey) -- but became a smash hit internationally.

Leaping, post-Creeping (1994-1996): Vaulted by the surprising popularity of "Creep" -- but leery of becoming a one-hit wonder -- Radiohead recorded a follow-up album, The Bends. Initially criticized as being "too rough" to sell, the album went on to produce five top 30 hits. guitar hero 3 - original video game soundtrack (2007)

The Guitar Hero III Companion Piece is a combination of two different products - a traditional soundtrack of music from the Guitar Hero III game and an expansion pack of songs for the game. We call this a "companion piece" since it is a compliment to the newest version of Guitar Hero III. This piece provides fans many of the key songs from the game as well as new songs/levels for them to play.

The music portion of the companion piece will feature songs from the Guitar Hero such as AFI "Miss Murder", Sonic Youth "Kool Thing", Queens of the Stone Age "3's and 7's", and many more.

The expansion portion for the game will literally be new levels for the game - new songs to be played in the Guitar Hero III game. These bonus songs will be delivered via a CODE on an insert in the CD package. This code is unique for Xbox Live, where the user can type in the code and download 3 exclusive tracks in guitar hero format directly into the Xbox game. These three "expansion songs" are unreleased material from 3 of the biggest rock acts in the world: * "Carcinogen Crush" from AFI (from a forthcoming EP of new material due in December) * "Tina" from Flyleaf * A remix of Marilyn Manson's "Putting Holes in Happiness" by Nick Zinner from Yeah Yeah Yeahs

On May, 2007, rumors of Rico Blanco quitting the groups surfaced. The band's management team refused to comment, as did the other members. It was not until a few more days before Rico Blanco, the band's chief composer, officially announced his departure from the group. Both Rivermaya and its management have taken the announcement in stride and have denied rumors that the band would disband as a result. "No one member is greater than the whole," declared Rivermaya management in an official statement released on June 14th, 2007. Both fans and industry insiders reacted with relief that the band would carry on.

Undeterred by the sudden abandonment, Rivermaya released a new single, "Sayang", penned by Japs Sergio and described by the band as "an open letter to the fans."
